Terms and Conditions

By placing an order with Pragmattical you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact us before placing an order. We reserve the right, at any time, to modify or alter these terms of use, and you agree to be bound by such modifications on subsequent visits. You should regularly check these terms for changes.

Our Terms and Conditions and your use of this website and any related sub-domains will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you agree to submit to the jurisdiction of the English courts. Your non-excludable statutory rights, however, are not affected.

A Contract between the customer Pragmattical for the sale of our products or services will exist once an order has been accepted, processed and despatched (at which point the buyer’s credit/debit card will be charged for the value of the goods and/or services despatched, through our payment processing gateways as advised). If payment is handled through other means such as Bank Deposit or Money Transfer, any goods despatch is after confirmed clearance of payments and applicable charges.

Prices and availability of products and services is subject to change without prior notice. In the event that a product or service is not available, you will be informed when we process your order. We try to ensure that the information on the website is accurate and current. We reserve the right to replace products and services, whenever necessary. All delivery dates quoted are estimated and may be subject to change. We cannot accept liability for any loss or damage (whether direct or indirect) for delivery at any time other than the estimated date. Please note that a signature may be required for delivery of tangible goods.

Your Right To Cancel
You may cancel your order (once accepted by us) for any reason up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days. There are no refunds for services including those we only source on your behalf such as domain names, and there are no refunds on software purchases, as they are of intangible nature.

Returns Policy
If you are unhappy with the products that you have chosen you may return them to us within 2 weeks of receipt, in unopened and unused condition or with deliverer’s report if damaged; with the exception of intangible products and services for which no refunds are offered. We will offer you an exchange or, at option, a refund provided that the returned products are complete, in perfect condition, unused, and with the original packaging. Please inform us BEFORE returning any goods, if applicable and we will advise of a return address.

For all returns, except where the product is faulty, you will be required to arrange and pay for the return of such products to us. Please indicate on the receipt (which arrived with your order) whether you would like a refund or exchange. Pack the unopened products and receipt back in the parcel and send them to an address we advise on notification of your wish to return.

We recommended that you obtain proof of posting returns. We can not accept responsibility for parcels lost in transit. We will only refund or provide an exchange for the costs of postage where the item returned is faulty and within designated period.

Payments and Taxes Obligations
We accept on-line payment in a secure environment by debit/credit card using, mostly through third party payment gateways such as Paypal.

All prices quoted on the Pragmattical website and any of its sub-domains are accurate at the time of publication and are quoted in Pounds Sterling (£), and currently without VAT charge. Any customs or import duties levied once the package or digital product or service sent to your destination country/territory will be your responsibility as we have no control over such charges and regulations. Incase of tangible products, delivery will be by arrangement.

Disclaimer & Limitations of liability
Pragmattical does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members agents directors or employees or for any fraudulent misrepresentation.

To the fullest extent permitted by law and save as provided above, neither Pragmattical nor any associates shall be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, or in negligence (whether on the part of Pragmattical or any of its members, agents, employees or otherwise) for any indirect special or consequential loss or damage (including but not limited to loss of profit or saving), costs, expenses or other claims for compensation whatsoever that arise out of or in connection with the use of this site or any of its sub-domains, the supply of the products or services or their use or resale by you.

“The limitations of liability in these conditions shall apply equally for the benefit of Pragmattical and any other associates of Pragmattical as if refers to Pragmattical including references to each such associate.”

We endeavour to ensure that the information on this site and any of its sub-domains is accurate and up to date, but do not give any warranty as to its accuracy or completeness, and Pragmattical will not be responsible for any errors or omissions or for the results arising from the use of such information.

Whereas Pragmattical takes reasonable steps to ensure a fast and reliable service, we will not be responsible for any disruption, loss or corruption of any material in transit, or loss or corruption of data when downloaded onto any computer system. The entire liability of Pragmattical in connection with any contract for any products and services to which these conditions apply shall not exceed the price of the products and services. Pragmattical and its associates and Proprietor will not be liable or in breach of the contract if any delay or failure was due to causes beyond our control.

Pragmattical may assign or transfer any of its rights or sub-contract any of the obligations under these terms and conditions to any third party. You may not assign or transfer any of your rights or sub-contract any of your obligations under these terms and conditions except with the specific permission in writing of Pragmattical.

No person or legal entity that is not a party to these terms and conditions shall have any right to enforce any term under the Contracts (Rights of Third Parties) Act. Nothing in these conditions is intended nor shall affect any of your statutory rights that may not be legally excluded.

International Access and Usage

This site and any of its sub-domains and the products and services provided are with respect to the jurisdictions of England. It is entirely your responsibility to ensure your use of this site and any of its sub-domains meets the legal requirements of access and export/import control law of your country/territory, as with customs and all taxation regulations and requirements.
